Terms & Conditions

Please read these terms carefully. They govern your use of Amanta's services and facilities.

These Terms and Conditions ("Agreement") set out the rights and responsibilities of Amanta Care Home ("Amanta", "we", "us", or "our") and the individuals — residents, families, and representatives ("you") — who engage with our residential care services at 82 Charoenkrung Road, Wat Phraya Krai, Bang Kho Laem, Bangkok 10120, Thailand.

By submitting an enquiry, completing an admission application, or using any of our services, you confirm that you have read, understood, and agree to be bound by this Agreement. If you do not agree, please do not proceed with an admission or service request.

SECTION 01

Definitions


"Service" — any residential care program, accommodation, or support offering provided by Amanta, including Assisted Living, Memory Care, and Respite Care.

"Resident" — an individual who is admitted to and resides within Amanta's facilities.

"Representative" — a family member, legal guardian, or authorized person acting on behalf of a Resident.

"We / Us / Our" — Amanta Care Home and its staff, management, and authorized agents.

"Agreement" — these Terms and Conditions, together with any Admission Agreement or Care Plan signed at the time of admission.

"Care Plan" — the individualized document outlining the specific support, routines, and preferences agreed upon for a Resident.

SECTION 02

Acceptance of Terms


This Agreement is formed at the point of submitting a completed admission application or, where applicable, upon written confirmation of a service request. Acceptance may be made by the Resident directly or by an authorized Representative where the Resident is unable to act on their own behalf.

Individuals must be 18 years of age or older to enter into this Agreement. Representatives acting on behalf of a Resident warrant that they hold the appropriate legal authority to do so.

Continued use of Amanta's services following any update to this Agreement constitutes acceptance of the revised terms.

SECTION 03

Service Description


Amanta offers three principal programs, each designed to meet different levels of need:

  • Residential Stay — Assisted Living (฿28,000/month): Long-term accommodation with daily personal care support, meals, housekeeping, and social programming.
  • Specialized Memory Care (฿45,000/month): A dedicated program within a secure wing for residents experiencing cognitive challenges, with structured routines and person-centered care.
  • Short-Term Respite Care (฿12,000/week): Temporary residential stays of one to four weeks, providing continuity of care while a primary caregiver takes a period of rest.

Service availability is subject to room capacity and care compatibility assessments conducted prior to admission. Amanta reserves the right to decline or withdraw an admission where the level of care required exceeds what we are able to safely provide.

SECTION 04

Admission & Eligibility


Prior to admission, Amanta will conduct a care needs assessment to determine whether our services are a suitable fit. This assessment may include a review of medical history, a conversation with the prospective Resident and their family, and a visit to our facility.

Accurate and complete information must be provided at the time of enquiry and admission. Withholding relevant medical, behavioral, or financial information may affect care planning and may constitute grounds for discharge.

Amanta's services are primarily designed for adults aged 60 and above, though exceptions may be considered on a case-by-case basis.

SECTION 05

Resident Rights


Every Resident at Amanta is entitled to:

  • Be treated with dignity, respect, and compassion at all times
  • Receive care that is responsive to their individual needs and preferences
  • Privacy in their personal space and in matters relating to their health
  • Participate in decisions about their care plan to the extent they are able
  • Receive visitors during designated visiting hours without undue restriction
  • Lodge a concern or complaint without fear of consequence
  • Have their cultural, spiritual, and personal preferences acknowledged

SECTION 06

Family & Guardian Responsibilities


Representatives agree to:

  • Provide accurate information about the Resident's health, history, and preferences
  • Respond in a timely manner to communications from Amanta regarding care updates
  • Ensure that personal belongings brought into the facility are clearly labeled and appropriate
  • Respect the routines, quiet hours, and shared spaces of other Residents
  • Meet payment obligations in accordance with the agreed schedule
  • Cooperate with discharge planning when a transition of care becomes necessary

SECTION 07

Payment Terms


All fees are quoted in Thai Baht (฿) and are payable in advance on a monthly basis for long-term programs, or in full prior to admission for Respite Care stays. A deposit equivalent to one month's fee may be required at the time of admission confirmation.

Invoices are issued on the first business day of each calendar month. Payment is due within 10 days of invoice issuance. Late payments may result in a service hold and, if unresolved within 30 days, may constitute grounds for discharge.

Fees are reviewed periodically. Residents and Representatives will receive at least 60 days' written notice of any fee adjustment. Continued residency following notice of a fee change constitutes acceptance of the revised rate.

Amanta accepts payment by bank transfer and other methods as agreed in writing at the time of admission. Receipts are provided for all payments.

SECTION 08

Cancellation & Discharge


Voluntary Departure: Residents or their Representatives may give notice of departure in writing. A notice period of 30 days is standard for long-term programs. For Respite Care, departure terms are outlined in the individual admission agreement.

Discharge by Amanta: In circumstances where a Resident's care needs have changed beyond what Amanta can safely provide, where there has been a material misrepresentation of health status, or where payment obligations have not been met, Amanta reserves the right to initiate a managed discharge process. We will always aim to do so with appropriate notice and in coordination with the family or Representative.

Refunds: Fees paid in advance for periods not yet commenced are generally refundable, less any applicable deposit or administrative charges, following the notice period.

SECTION 09

Intellectual Property


All content on the Amanta website and in printed materials — including text, images, branding, and care documentation templates — is the property of Amanta or its licensors and is protected under applicable intellectual property law.

You may not reproduce, distribute, or publicly display any part of our materials without prior written permission. Nothing in this Agreement grants you any ownership rights in Amanta's intellectual property.

SECTION 10

Confidentiality


Amanta treats all information relating to Residents — including health records, care plans, and personal details — with strict confidentiality in accordance with the Personal Data Protection Act B.E. 2562 (PDPA) of Thailand.

Information is shared with third parties only where this is necessary for the delivery of care (e.g., consulting medical specialists) or where required by law. Please refer to our Privacy Policy for a full explanation of how personal data is handled.

SECTION 11

Disclaimers


Amanta provides residential care and personal support services. We are not a medical facility and do not provide clinical diagnosis, specialist medical treatment, or hospital-level nursing care. Residents who require acute medical attention will be supported in accessing appropriate external healthcare services.

Our website and materials are provided for informational purposes and do not constitute medical, legal, or financial advice. Outcomes vary between individuals and we make no representations regarding specific results from our care programs.

SECTION 12

Limitation of Liability


To the extent permitted by Thai law, Amanta's total liability to a Resident or Representative in connection with any claim arising from these Terms shall not exceed the total fees paid in the three months preceding the event giving rise to the claim.

Amanta shall not be liable for losses arising from circumstances beyond its reasonable control, including natural disasters, public health emergencies, utility failures, or actions of third-party service providers.

Nothing in these Terms limits liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

SECTION 13

Indemnification


You agree to indemnify and hold harmless Amanta, its staff, and management from any claims, losses, or expenses (including reasonable legal costs) arising from your breach of this Agreement, your provision of inaccurate information, or the unauthorized use of our services or facilities.

SECTION 14

Governing Law & Dispute Resolution


This Agreement is governed by the laws of the Kingdom of Thailand. Any dispute arising in connection with these Terms shall first be addressed through good-faith discussion between the parties.

If an informal resolution cannot be reached within 30 days, the matter may be referred to mediation before the Thai Consumer Protection Board or pursued through the competent courts in Bangkok, Thailand.

SECTION 15

Changes to These Terms


Amanta may update these Terms from time to time to reflect changes in our services, legal obligations, or best practices. When changes are made, the "Last Updated" date at the top of this document will be revised.

For existing Residents, material changes will be communicated in writing with at least 30 days' notice. Continued use of our services after that period constitutes acceptance of the updated terms.
